Terms of Service

Friendful is a personal organization and AI-assisted relationship tool designed to help you remember important details about the people in your life and stay connected more thoughtfully.

Friendful may allow you to:

• create profiles for people in your life;
• save notes, dates, photos, reminders, and interaction history;
• receive reminders and suggestions;
• record and transcribe voice input;
• generate AI-supported answers, notes, and summaries;
• open messaging apps to contact people.

Friendful is intended to support your memory and judgment. It does not replace personal communication or your own decision-making.

You must be at least 13 years old to use Friendful.

If you are under the age of legal majority in your country, you may use Friendful only with the permission of a parent or legal guardian.

Friendful uses Sign in with Apple and Google Sign-In.

You are responsible for:

• providing accurate account information;
• protecting access to your device and sign-in method;
• activity carried out through your account.

Please contact us if you believe your account is being used without your permission.

“User Content” means information you choose to add to Friendful, including names, contact details, dates, notes, photos, reminders, interaction history, voice transcriptions, AI conversations, and generated notes.

You retain any rights you have in your User Content.

You allow Friendful to store, process, and transmit your User Content only as needed to provide, operate, and secure the features you use, including through the service providers described in the Privacy Policy.

This permission ends when the relevant content is deleted, subject to the limited temporary retention described in the Privacy Policy.

Friendful does not acquire ownership of your User Content.

We do not use your saved content for advertising or to train general-purpose AI models.

You are responsible for the information you choose to add and for using Friendful lawfully and respectfully.

You must not use Friendful to harass, threaten, unlawfully monitor, impersonate, or otherwise violate the rights of another person.

Friendful uses Google Vertex AI to provide AI-supported answers, notes, summaries, suggestions, and voice transcription.

AI-generated content may not always be accurate or suitable for every situation. Please use your own judgment when relying on it or acting on it.

Friendful does not provide medical, psychological, legal, financial, or emergency advice and is not a substitute for qualified professional support.

You remain responsible for your decisions, communications, and actions.

When you use voice transcription, the audio is temporarily sent to Google Vertex AI for processing.

The original audio is not stored in Friendful’s cloud storage. Text that you choose to submit or save, together with notes or AI-generated content created from it, may be stored as User Content.

You are responsible for ensuring that any recording you make complies with applicable laws, including rules concerning the recording of other people.

Friendful may offer both free and paid features.

The features included in each plan are shown in the App.

Premium subscriptions are purchased through the Apple App Store or Google Play.

Before completing a purchase, the purchase screen will show the available plan, price, billing period, included features, and any free-trial terms.

Prices may vary depending on country, currency, taxes, platform, or promotional offer.

Automatic Renewal

Unless otherwise stated before purchase, subscriptions renew automatically at the end of each billing period until cancelled.

The applicable app store charges the payment method associated with your store account.

Free Trials

Where a free trial is offered, its duration and the price charged afterward will be shown before you subscribe.

Unless you cancel before the trial ends, the subscription will convert into a paid, automatically renewing subscription.

Free trials may be available only to eligible users.

Managing and Cancelling a Subscription

Subscriptions must be managed or cancelled through the Apple App Store or Google Play account through which they were purchased.

If you cancel, your subscription will not renew. You will normally retain premium access until the end of the current billing period.

Deleting the Friendful App or your Friendful account does not automatically cancel an active subscription. You must cancel it separately through the applicable app store.

Payments and Refunds

Apple or Google processes subscription payments and administers refunds through the applicable app store.

Payments are generally non-refundable, subject to the applicable app store’s rules and mandatory law.

Price Changes

Subscription prices may change.

Any price change affecting an existing subscription will be handled through the applicable app store.

Some features may require permission to access:

• contacts;
• photos selected by you;
• the microphone;
• notifications.

You can manage these permissions through your phone’s settings. Disabling a permission may prevent the related feature from working.

Notification previews may display a person’s name, birthday, or reminder information. You can manage notification and lock-screen settings through your phone’s settings.

Friendful may allow you to open WhatsApp or your device’s default messaging app using a phone number saved in Friendful.

Friendful does not read, import, or receive the contents of your messages.

Third-party services are operated independently and are governed by their own terms and privacy practices.

You must not:

• use Friendful for unlawful, fraudulent, harmful, or abusive purposes;
• interfere with or attempt to gain unauthorized access to Friendful or its systems;
• introduce malware or other harmful code;
• use unauthorized automated methods to scrape or extract data;
• bypass subscriptions, access restrictions, or security measures;
• use Friendful in a way that violates the rights of another person.

Friendful and its licensors retain all rights in the App, including its:

• software and technology;
• design and functionality;
• name, logo, and branding;
• original text and content.

These rights do not include your User Content.

Subject to these Terms, you receive a personal, non-exclusive, and non-transferable right to use Friendful for its intended purpose.

You may not copy, sell, license, distribute, or commercially exploit Friendful or its content without permission.

We work to keep Friendful reliable and available, but temporary interruptions or technical errors may occur.

Friendful may change, add, limit, or discontinue features for technical, security, legal, or business reasons.

Material changes affecting an active paid subscription will be handled in accordance with applicable law and app-store requirements.

You may stop using Friendful at any time.

You can delete your account directly within the Friendful App or through the account-deletion page on the Friendful website.

Account deletion is handled as described in the Privacy Policy.

Deleting your account does not automatically cancel an active subscription.

Premium access may be suspended if the related payment or subscription can no longer be verified.

Friendful may suspend, restrict, or terminate access where reasonably necessary because:

• you materially violate these Terms;
• your use creates a significant legal or security risk;
• Friendful is required to do so by law;
• Friendful or a relevant service is discontinued.

Where reasonably possible, we will provide notice before suspending or terminating an account.

Friendful is provided on an “as available” basis.

While we aim to provide a reliable service, we cannot guarantee uninterrupted or error-free operation or that reminders and notifications will always be delivered at a particular time.

Nothing in these Terms limits warranties, remedies, or consumer rights that cannot legally be limited.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by law, Friendful is not liable for indirect or consequential losses arising from:

• the use or unavailability of the App;
• reliance on AI-generated content;
• missed reminders or notifications;
• the operation or availability of third-party services.

These Terms are governed by Swiss law.

Mandatory consumer rights in your country of residence remain unaffected.

Friendful may update these Terms when the App, its features, service providers, or applicable requirements change.

The current version will be available on the Friendful website and accessible through the App.

If a change is material, Friendful may provide additional notice in the App or by email. Where required, users may be asked to accept the updated Terms.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A failure to enforce a provision does not waive the right to enforce it later.

These Terms, together with the Privacy Policy and the purchase information shown by the applicable app store, form the agreement concerning your use of Friendful.
